Asbestos Laws and Compliance

When it comes to asbestos compliance, the person with “management or control” of a workplace must ensure the business is meeting all requirements. This may include on-site asbestos identification, the creation of an asbestos register and the implementation of an asbestos management plan.

According to the WHS Act, any person conducting a business or undertaking (PCBU) is responsible for:

Using a competent person to conduct an asbestos audit to identify all asbestos or asbestos containing material (ACM)
Clearly labelling the location and presence of all ACM in the workplace
Ensuring that an asbestos register is prepared, maintained, reviewed and kept at the workplace
Developing an asbestos management plan and reviewing it at least every 5 years
Controlling the risk of exposure for all employees
Ensuring suitable and adequate training is provided
